Amongst other things, these measures gave significant pow<\/span><\/span><span id=\"page57R_mcid33\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">ers to governments in order to curb the spreading of a virus, which has shown itself <\/span><\/span><span id=\"page57R_mcid34\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">to be both indiscriminate and deadly. Nevertheless, exceptional measures, however <\/span><\/span><span id=\"page57R_mcid35\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">necessary in the short term, can have adverse consequences both on the enjoyment <\/span><\/span><span id=\"page57R_mcid36\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">of human rights specifically and democracy more generally. Not only are liberties <\/span><\/span><span id=\"page57R_mcid37\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">severely restricted and normal processes of democratic deliberation and accountabil<\/span><\/span><span id=\"page57R_mcid39\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">ity constrained but the duration of exceptional powers is also often unclear. One po<\/span><\/span><span id=\"page57R_mcid41\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">tentially ameliorating measure is the use of sunset clauses: dispositions that deter<\/span><\/span><span id=\"page57R_mcid42\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u2013<\/span><\/span><span id=\"page57R_mcid43\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">mine the expiry of a law or regulation within a predetermined period unless a review <\/span><\/span><span id=\"page57R_mcid44\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">determines that there are reasons for extension. The article argues that without ef<\/span><\/span><span id=\"page57R_mcid46\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">fective review processes, far from safeguarding rights and limiting state power, sun<\/span><\/span><span id=\"page57R_mcid47\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u2013<\/span><\/span><span id=\"page57R_mcid48\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">set clauses can be utilized to facilitate the transferring of emergency powers whilst <\/span><\/span><span id=\"page57R_mcid49\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">failing to guarantee the very problems of normalized emergency they are included to <\/span><\/span><span id=\"page57R_mcid50\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">prevent.
